Forbes reports that a United States Marine captain charged with DUI manslaughter stemming from an accident that took place last April in Tampa will be offering an insanity defense at trial. According to his attorney, the accident was caused by the Marine's post-traumatic stress disorder and a traumatic brain injury.
The conditions were, according to his attorney, acquired during his service in Afghanistan and Iraq between 2003 and 2009. His conditions, which allegedly were not adequately treated by the Marine Corp, led the Marine to have a "dissociative episode" prior to the accident. Sources said the Marine believed he was on a military deployment at the time of the accident.
Marine Corps investigators published an 860-page document detailing regarding the Marine's case, which detailed various missteps the Corps had taken in regard to evaluating and treating the Marine's post-traumatic stress disorder. The report recommended that the Corps make improvements to its procedures for such matters, which are currently largely based on self-diagnosis and self-reporting.
According to the Marine's family, he began having dissociative episodes after being transferred to a wounded warrior battalion in California following combat wounds in 2009. He apparently kept the episodes quiet so as to be able to advance his career.
The Marine is currently awaiting his trial in a Tampa jail, and is set for a hearing on November 14. According to his attorney, the will be entering an insanity defense at trial, based on his mental condition at the time of the accident.
